The Aiken County Master in Equity Office will be closed through May 1, 2020. Services will continue by telephone, mail and online.
The Chief Justice of the South Carolina Supreme Court, issued an Order on March 18, 2020, ordering: “a Moratorium in Master-in-Equity courts statewide on foreclosure hearings, foreclosure sales, writs of assistance and writs of ejectments, nor should Masters-in-Equity proceed in any other manner regarding foreclosures until directed by subsequent order by the Chief Justice.”
In addition, as a Court with full powers of a Circuit Court when a matter is referred to it, this Court has cancelled all cased scheduled for hearing in accord with the Order of the Chief Justice dated March 20, 2020, which states: “All previously scheduled terms of court from March 23, 2020 through May 1, 2020 are hereby canceled, and all judges who are not assigned to vacation, official leave or an Administrative Week shall be assigned to chambers.”
In accord with these Orders by the Chief Justice, as Master in Equity for this County, I have cancelled all matters scheduled for hearing before this Court through May 1, 2020. Cases previously noticed for hearing by the moving party will be rescheduled upon request once the moratorium is lifted and terms of court are reinstated.
Post-sale matters (execution of Master’s Deeds, Report of Sale, and Surplus matters pursuant to Rule 71 (b) and (c)) are construed as falling within the Chief Justice’s mandate that the Master shall not proceed in any manner regarding foreclosure until as directed by subsequent order by the Chief Justice.
Prior to the Chief Justice’s Order, this Court set May 12, 2020 as a judicial sales date for Aiken County. This sale will be cancelled unless a change directed by Chief Justice Beatty allows foreclosure sales to proceed. On or about April 20, 2020 I will post a roster notice concerning whether the May 12, 2020 sale will go forward or be cancelled. If not cancelled, I will post the sales roster as soon as practicable.
Lawyers representing clients in this court pursuing foreclosure of FHA Single Family mortgage insured loans are required to determine whether any sales on May 12, 2020 are stayed under any HUD directive even if the Order was signed prior to March 18, 2020.
